Critical Update - 9/10/2012:
Today, the PUC released Impact Fee Payments to Date [xlxs]. It gives, by operator, the number of horizontal and vertical wells subject to the fee (and distribution), the fee due, and the amount paid to date. SWEPI did take advantage of the Reconsideration Order option (below) and verified to the PUC that all but 1 (one) of their vertical wells (statewide) is non-producing and, thus, are not subject to the impact fee.

The PUC also notes for SWEPI: "List calculated by data received from the state Department of Environmenal Protection & adjusted by the PUC".

It's unknown what this means for Tioga County as a whole; that depends on other counties' proportion of non-producing vertical wells. But it definitely means that this distribution estimate within Tioga County municipalies IS NOT VALID.

This is not a Final Order, but indications are that the distribution to counties and municipalities may not be apportioned as expected. First, only the wells on the PA DEP SPUD list which are subject to the Impact Fee will be included in the well counts. And, "a vertical gas well is only subject to the impact fee if it produces sufficient quantities of gas to qualify the well, by definition, as a vertical gas well." (If not, it's not classified as an unconvemtional gas well, but as a stripper well.)

For this initial year, the PUC will assume a vertical well on the DEP SPUD list is producing unless the operator verifies by August 15 that it isn't. For subsequent years, operators will be required to submit monthly production information to the PUC.

Having done an estimate of the Tioga Couty PA distribution several months ago, this has the potential to negatively impact not only the municipalities with a number of vertical wells drilled primarily to hold leases. But also municipalities which have only vertical wells or who qualify for part of the distribution based on their proximity to vertical wells in other municipalities.
8/6/2012 - [End Important Update]

Purpose:
The main objective of this project is to provide a preliminary estimate of the amounts the individual Tioga County Municipalities might be allocated in the 2012 distribution. While the calculations are believed to be correct, (1) some of the data sources need to be "cleaned up" and/or are not up-to-date and (2) parts of Act 13 are subject to interpretation.

Assumptions were made that (1) the Fund will contain $185,000,000 after the off-the-top deductions and the County/Municipality 60% share will be $111,000,000, and (2) 5,168 Marcellus Shale gas wells were SPUD through 2011. The SPUD Report for Tioga County was downloaded from the DEP website and Act 13 [HB1950 pn3048] from the Legislature's.
